4. Products and Orders

All products listed on bexclusive.org are subject to availability. We make every effort to display accurate product descriptions, images, and pricing; however, errors may occasionally occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

When you place an order, you will receive an order confirmation email. This email does not constitute acceptance of your order; it is simply a confirmation that we have received it. We reserve the right to accept or decline your order for any reason, including product availability, errors in product or pricing information, or suspected fraud. A contract is formed only when we ship the product and send you a shipping confirmation.

5. Payment

We accept major credit cards, debit cards, and other payment methods as indicated on the Site. By providing payment information, you represent that you are authorized to use the designated payment method. All payments are processed through secure third-party payment processors. We do not store your full credit card details on our servers.

All prices are listed in U.S. dollars unless otherwise stated. You are responsible for any applicable taxes, duties, or customs fees associated with your order, particularly for international shipments. If your payment is not successfully authorized, we reserve the right to cancel your order.

6. Shipping and Delivery

Shipping and delivery terms are governed by our separate Shipping Policy, which is incorporated into these Terms by reference. We offer free standard shipping to most global destinations, with estimated delivery times of 10–15 business days for domestic orders and 15–30 business days for international orders. Delivery times are estimates and not guaranteed.

Once your order ships, you will receive a tracking number via email. Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. We are not responsible for delays caused by customs clearance, local postal services, or other circumstances beyond our control.

7. Returns and Refunds

Our Return Policy governs all returns, exchanges, and refunds. In general, we accept returns on new, unused items in original packaging within 30 days of delivery. Certain products, such as opened fragrance oils, used kettles, or personalized items, may not be eligible for return due to hygiene, safety, or customization reasons. Refunds are processed to the original payment method within 7 business days after we receive and inspect the returned item. Original shipping costs are non-refundable unless the return is due to our error or a defective product. 8. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not use the Site in any way that violates any applicable federal, state, local, or international law or regulation. You represent and warrant that you own or control all rights to your User Content and that it does not infringe upon the intellectual property rights of any third party.

11. Limitation of Liability

Our total liability to you for all claims arising out of or relating to these Terms or your use of the Site shall not exceed the total amount you paid to us during the twelve (12) months immediately preceding the event giving rise to liability, or one hundred U.S. dollars (USD $100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Colorado. You consent to the personal jurisdiction and venue of such courts.

Before filing any claim, you agree to first contact us at made@bexclusive.org to attempt to resolve the dispute informally. If we are unable to resolve the dispute within 30 days, either party may pursue formal legal action. YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE ANY DISPUTE WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at made@bexclusive.org. Upon termination, all licenses and other rights granted to you under these Terms will immediately cease. We are not responsible for any loss or damage resulting from the termination of your account.

14. General Provisions

These Terms, together with our Privacy Policy, Return Policy, and Shipping Policy, constitute the entire agreement between you and bexclusive.org regarding your use of the Site. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms at our discretion. These Terms are drafted in the English language. In the event of any conflict between the English version and any translated version, the English version shall prevail.
